AutoCupid Platform Agreement

Welcome to AutoCupid ("Platform", "we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of the AutoCupid platform, including our website, web application, and all related services.
By creating an account, accessing, or using AutoCupid in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
AutoCupid is operated in Australia and these Terms are governed by the laws of the Commonwealth of Australia and the relevant State or Territory in which you reside.
2.1 AutoCupid is a technology platform that connects vehicle owners ("Customers") with independent automotive service providers ("Repairers"). The Platform facilitates the discovery, communication, and payment between Customers and Repairers.
2.2 AutoCupid does not directly provide automotive repair, maintenance, towing, or any other vehicle services. All services are performed by independent Repairers who are solely responsible for the quality, safety, and legality of their work.
2.3 AutoCupid acts solely as an intermediary and is not a party to any agreement between Customers and Repairers regarding the provision of automotive services.
3.1 You must be at least 18 years of age to create an account and use the Platform.
3.2 You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.4 AutoCupid reserves the right to suspend or terminate any account that violates these Terms, provides false information, or engages in fraudulent or harmful behaviour.
4.1 Repairers must hold a valid Australian Business Number (ABN) and all licences required to perform their advertised services in their operating jurisdiction.
4.2 Repairers must maintain current public liability insurance with a minimum coverage of $5,000,000 AUD and provide proof upon request.
4.3 Repairers are solely responsible for the quality, safety, and warranty of all work performed. Repairers must comply with all applicable Australian Consumer Law obligations.
4.4 Repairers agree to provide honest and accurate quotes, arrive within reasonable timeframes after accepting a job, and communicate promptly with Customers regarding any delays or issues.
4.5 Repairers must not solicit Customers to transact outside the Platform to avoid service fees. Violation of this clause may result in immediate account termination.
5.1 Customers must provide accurate vehicle information, location details, and a clear description of the service required when submitting a job request.
5.2 Customers must ensure safe access to their vehicle for the Repairer and be available (in person or by phone) during the scheduled service time.
5.3 Customers must not engage in abusive, threatening, or discriminatory behaviour towards Repairers.
5.4 Customers acknowledge that repair quotes are estimates and that additional work may be identified once the Repairer inspects the vehicle. Any additional work requires Customer approval before proceeding.
6.1 Connection Fee: A non-refundable connection fee of $4.99 AUD is charged to the Customer when a Repairer accepts their job request. This fee covers the cost of matching and platform facilitation.
6.2 Repairer Service Fee: A flat service fee of $14.99 AUD is charged to the Repairer upon job completion. This fee covers platform facilitation and is not passed on to the Customer.
6.3 Customer Payment: Customers pay only the connection fee ($4.99) and the Repairer's quoted price. No additional platform fees are charged to Customers.
6.4 Payment Processing: All payments are processed securely through Stripe. By using the Platform, you agree to Stripe's terms of service and privacy policy.
6.5 Fee Changes: AutoCupid reserves the right to modify fees with 30 days' written notice to all users. Continued use of the Platform after fee changes constitutes acceptance.
7.1 Customer Cancellation (Before Acceptance): Customers may cancel a job request at any time before a Repairer accepts it, at no charge.
7.2 Customer Cancellation (After Acceptance): If a Customer cancels after a Repairer has accepted but before work commences, the connection fee is non-refundable unless the cancellation is due to Repairer delay or misconduct.
7.3 Repairer Cancellation: If a Repairer cancels an accepted job or fails to arrive, the Customer's connection fee will be fully refunded.
7.4 Dispute Resolution: For disputes regarding repair quality, Customers must notify AutoCupid within 48 hours of job completion. AutoCupid will facilitate communication between parties but is not responsible for resolving workmanship disputes.
7.5 Chargebacks: Initiating a chargeback or payment dispute without first contacting AutoCupid support may result in account suspension pending investigation.
8.1 To the maximum extent permitted by law, AutoCupid's total liability to any user is limited to the total platform fees (connection fee or repairer service fee) paid by that user in the 12 months preceding the claim.
8.2 AutoCupid is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
8.3 Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law, including guarantees relating to the supply of services.
9.1 All content, branding, logos, software, and materials on the Platform are the property of AutoCupid or its licensors and are protected by Australian and international intellectual property laws.
9.2 Users retain ownership of content they upload (reviews, photos, business descriptions) but grant AutoCupid a non-exclusive, royalty-free licence to use, display, and distribute such content in connection with the Platform.
9.3 You may not copy, modify, distribute, or reverse-engineer any part of the Platform without prior written consent.
10.1 Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal information in accordance with the Australian Privacy Act 1988.
10.2 By using the Platform, you consent to the collection and use of your location data for the purpose of connecting you with nearby Repairers and enabling real-time tracking during active jobs.
10.3 We will never sell your personal information to third parties. Data is shared only as necessary to facilitate the services you request.
11.1 Users may post reviews and ratings after completed jobs. Reviews must be honest, factual, and relate to the actual service experience.
11.2 AutoCupid reserves the right to remove reviews that contain defamatory content, hate speech, personal attacks, spam, or content unrelated to the service received.
11.3 Repairers may not offer incentives (discounts, free services) in exchange for positive reviews or removal of negative reviews.
12.1 You may delete your account at any time through the Profile settings. Account deletion is permanent and cannot be undone.
12.2 Upon account deletion, your personal data will be removed in accordance with our Privacy Policy. Some data may be retained as required by law (e.g., transaction records for tax purposes).
12.3 AutoCupid may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms, is harmful to other users, or is otherwise objectionable.
12.4 Outstanding payments remain due upon termination. Repairers with pending payouts will receive their earnings according to the standard payout schedule.
13.1 In the event of a dispute, parties agree to first attempt resolution through AutoCupid's internal support process by contacting [email protected].
13.2 If a dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation administered by the Australian Disputes Centre (ADC) in accordance with ADC Mediation Rules.
13.3 Nothing in this clause prevents a party from seeking urgent injunctive relief from a court of competent jurisdiction.
You agree to indemnify, defend, and hold harmless AutoCupid, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to:
15.1 Governing Law: These Terms are governed by the laws of Australia. Any legal proceedings must be brought in the courts of the State or Territory in which the relevant party resides.
15.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and AutoCupid regarding use of the Platform.
15.4 Modifications: AutoCupid reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.
15.5 No Waiver: Failure by AutoCupid to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.6 Assignment: You may not assign or transfer your rights under these Terms without AutoCupid's prior written consent. AutoCupid may assign its rights without restriction.
